Driving While Intoxicated
You can be arrested for DWI if police think you are impaired by alcohol. Your BAC does NOT have to be .08% for you to get arrested. We have clients who have come to us after being arrested for having a BAC as low as .05%
The only way to make sure you don't get arrested for DWI is to completely abstain from alcohol on the days that you drive a car.
Driving While Ability Impaired - Drugs
Even with a BAC of 0.0%, police will arrest you if think you are impaired (to any extent) by any drug, whether its a prescription drug, an over-the-counter medication, marijuana, or illegal drugs.
They will call in a Drug Recognition Expert (DRE) to examine you. After an examination, the DRE will declare their opinion that you were impaired by a Central Nervous System Depressant, along with whatever you admitted to taking that day. Racing pulse?
CNS Depressant.
Slow pulse?
CNS Depressant.
Slow speech?
CNS Depressant.
Fast speech?
CNS Depressant.
If it wasn't so serious it would be a joke.
Vehicular Homicide
If somebody is killed in a vehicle collision linked to drinking and driving, somebody else is likely to be charged with vehicular homicide.
